Nigo Trading Fzco, (“nigo,” “we,” “us,” “our”) provides certain services relating to the sale to, and purchase and receipt by, consumers of gift cards, in physical and/or electronic form (“Gift Cards,” “Cards”) through our website located at www.nigo.co ; the mobile version of this website, and any other websites we have now or in the future that reference these Terms of Use (collectively, the “Site”).

By visiting or completing a transaction on the Site, you agree to these Terms of Use and any additional terms applicable to certain services or programs in which you may elect to participate. You also agree to our Privacy Statement, incorporated herein by reference and located at https://www.nigoco/privacy-policy/ (“Privacy Statement”), and you acknowledge that you will regularly visit the Terms of Use and our Privacy Statement to familiarize yourself with any and all updates. The Privacy Statement, together with these Terms of Use, and any other terms contained herein or incorporated herein by reference, are collectively referred to as “Terms of Use.” The term “using” also includes any person or entity that access or uses the Site with crawlers, robots, data mining, or extraction tools or any other functionality.

By using the Site and thus accepting these Terms of Use:  nigo grants you a limited, nontransferable, nonexclusive, revocable license to use the Site pursuant to these Terms of Use and pursuant to any additional terms and policies set forth by Nigo

Nigo retains the right, at our sole discretion, to deny service or use of the Site or an account to anyone at any time and for any reason. Although we use reasonable efforts to keep the Site and your account accessible, the Site and/or your enrollment may be unavailable from time to time. You understand and agree that there may be interruptions in service or events, Site access, or access to your enrollment due to circumstances both within our control (e.g., routine maintenance) and outside of our control. You agree that Nigo will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Site or the services offered through it.

Use of the Site

As conditions of your use of the Site, and in addition to other conditions set forth in these Terms of Use, you agree that:

(1) You are of sufficient age, and are legally authorized, to register and use this Site, and to use Nigo products and services, as specified in these Terms of Use;

(2) You are able to create a binding legal obligation;

(3) You are not barred from receiving products or services under applicable law;

(4) You will not attempt to use the Site with crawlers, robots, data mining, or extraction tools or any other functionality;

(5) Your use of the Site will at all times comply with these Terms of Use;

(6) You will use the Site only for legitimate transactions that comply with the letter and spirit of the terms of the respective offers;

(7) You have the right to provide any and all information you submit to the Site, and all such information is accurate, true, current, and complete;

(8) You will update and correct information you have submitted to the Site and ensure that it is accurate at all times (out-of-date information will invalidate your enrollment); and,

User Content

With respect to the content or other materials you upload through the Site or share with other users or recipients (collectively, “User Content”), you represent and warrant that you own all right, title, and interest in and to such User Content, including, without limitation, all copyrights, and you grant Nigo and its affiliated companies a nonexclusive, worldwide, royalty free, fully paid up, transferable, sublicensable, perpetual, irrevocable license to copy, display, upload, perform, distribute, store, modify, and otherwise use your User Content in connection with the operation of the Site or services offered through the Site or the promotion, advertising, or marketing thereof, in any form, medium, or technology now known or later developed.

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information about the Site (“Submissions”), provided by you to Nigo are non-confidential, and Nigo is entitled to the unrestricted use and dissemination of these Submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

Third Party Material

Under no circumstances will Nigo be liable in any way for any content or materials of any third parties (including users), including, but not limited to, for any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any such content. You acknowledge that Nigo does not pre-screen content, but that Nigo and its designees have the right (but not the obligation) in their sole discretion to refuse or remove any content that is available via the Site. Without limiting the foregoing, Nigo and its designees have the right to remove any content that violates these Terms of Use or is deemed by Nigo, in its sole discretion, to be otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content.

Service Content, Trademarks

You acknowledge and agree that the Site may contain content or features (“Service Content”) that are protected by copyright, patent, trademark, trade secret, or other proprietary rights and laws. Except as expressly authorized by Nigo, you agree not to modify, copy, frame, scrape, rent, lease, loan, sell, distribute, or create derivative works based on the Site or the Service Content, in whole or in part, except that the foregoing does not apply to your own User Content (as defined above) that you legally upload to the Site. In connection with your use of the Site, you will not engage in or use any data mining, robots, scraping, or similar data gathering or extraction methods. Any use of the Site or the Service Content other than as specifically authorized herein is strictly prohibited. The technology and software underlying the Site or distributed in connection therewith are the property of Nigo, our affiliates and our partners (the “Software”). The Nigo name and logos are trademarks and service marks of Nigo (collectively the “Nigo Trademarks”). Other company, product, and service names and logos used and displayed via the Site may be trademarks or service marks of their respective owners who may or may not endorse or be affiliated with or connected to Nigo. Nothing in these Terms of Use or the Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any of Nigo Trademarks displayed on the Site, without our prior written permission in each instance. All goodwill generated from the use of Nigo Trademarks will inure to our exclusive benefit.

Although every care has been taken to assure the accuracy of the information on this website / app Nigo provides this information “AS IS” and DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
